Reportable assaults are those types of actions that
are characterized as violent and deliberate physical attacks on people. Any
sort of hitting, kicking or punching (irrespective of whether it has caused
harm to the person or not) comes under a
chargeable offense.
Taking reasonable measures to safeguard the uniqueness
of a staff member, who formulates an assault report and also protects them from getting victimized.
What
comes under a reportable assault?
According to Act (section 63-1AA), a reportable
assault is defined in the following ways:
- Any type of unlawful sexual contact with residents of an old age care home, or
- Use of physical force on residents of an old age care home,
- Unethical sexual contact that is done to capture any sort of sexual contact, without seeking the consent of the person.
People who are found with a mental or cognitive disorder, then the resident would be considered to give an informed consent.
How is
the case handled?
If an assaulted person discloses about the assault and
it is found to qualify for protection under the above-mentioned Act, then the
identity of the victim must be protected by the approved provider.
An approved provider needs to fill up the reportable
assault form and send it to the concerned department via email. Proper care planning
makes sure that the person does not remain victimized and get necessary
assistance as soon as possible.
